Hunting on a Trust Farm ?

OK long story short my Grandmother set up a Trust for all the land she got from her family and what her and Gramps bought

So this summer I bought out 2 cousins share ...so I now own 2/9 of the trust land and may buy another 1/9 this winter as my Uncle in Canada says his tax's , he has to pay eat up more than he ever makes

So my question .....When I deer hunt on the trust land
Can I use a land owners tag ?

I called the local GW , but he has not gotten back to me with a final Yes or No

I figured someone here might know
As I hope to start bow hunting 1 of the farms in Sandusky Co later this week
I scouted the farm this morning and there is a good chunk of lime stone ridge land that is ....well most of it , thick is a understatement
But I saw a ton of tracks , some doe's and several decent bucks as I scouted

So I figured I would give it a try
But don't want a ticket for using the wrong tag

Call your local DNR office during business hours. Somebody there must know. GW may not call you back.

It will somewhat depend on how the trust is written and how that works with the language in the IRC regarding landowner rights for hunting.

That is why no GW is giving an answer.

The in laws had this issue when they set up theirs for the farm.

This could be comparable to a group of guys calling themselves a hunting club, purchasing acreage as a partnership or corporation. say the group was 10 persons ??? what about 100 partners not buying tags ????

It may boil down to who would actually get cash if the entire property was sold.

It gets interesting in cases like these. We own a property in the name of our LLC. I am the sole proprietor of the LLC. Technically, I do not think we can use a landowner tag on this because the land is not deeded in my name and my wife's name. I know I would call for verification or buy a tag to be safe.

I called the local GW , his house phone and talked right to him ....We get crop damage permits through him for coon and geese most years and deer once in a while
But he would not give me a yes or no till he talked to someone else
As he looked in his books and he told me the books are as clear as mud

I have a tag ...but "IF" I can use a land owners tag ...I could hang on to the tag and use it later

Worst case , I use a $24 tag and have to buy another

I am thinking in your favor John. What would be the difference......8 people own say 40 acres....or 8 people own 5 acres each? Taxes are still getting paid on the land.

I use landowner tags and don't live on either property my dad owns. By resident, they mean resident of Ohio. If you own the land, are a spouse or child of the person who owns the land, you can use a landowner tag.

I grew up in Erie/Sandusky County, there ain't enough deer to use land owner tags lol, sounds like you have nice spot though, I would make it a big buck honey hole from what you described. Just out of curiosity how many deer you looking to kill on this property a year?

I would imagine it will come down to IF your name is on the deed. Back when the landowner law did not take into account state residency I asked about it regarding our land contract. The first couple of years they said the contract was good enough, to keep a copy on my person. As time went on though they (ODNR) stated that my name had to be on the deed in order to qualify. Now with the landowner exemption changing some my state (Mich) does not allow landowners from Ohio to hunt free on land they may own there, so I cannot hunt free on land I own in Ohio. But me and my kids can still fall under the children and grandchildren part of it.

I think if you read the LLC exemption here, it addresses John's issue. There are more than 3 people in the trust, therefore he needs a tag. That's how I read it.

When John owns 7 shares of the 9 he'll be OK.
I just think the State law on grandkids is BS, my 3 kids can hunt on my property but the grandkids need deer tags. That rule surely doesn't promote future young hunters to start hunting.
