Not sure if this has ever been covered or not, if it has I couldn't find it. My father in law and I had a discussion(mild argument) lol about when you can and can't be in the woods during gun season. I couldn't find any definitive answer in the regs that was black and white and was hoping someone could clear it up. Say someone goes into the woods before daylight and either climbs into a stand or sets on the ground and waits on the sunrise, are they breaking the law? I have always assumed you could go in the woods at dark and wait on shooting light so long as the gun wasn't loaded and they weren't attempting to shoot anything. He on the other hand believes you have to wait until legal "shooting" time to enter the woods period. This is what the definitions of hunting per the regs say:
HUNTING means pursuing, shooting, killing, following after or on the trail of, lying in wait for, shooting at, or wounding wild birds or wild quadrupeds while employing any device commonly used to kill or wound wild birds or wild quadrupeds, whether such acts result in such killing or wounding or not. It includes every attempt to kill or wound and every act of assistance to any other person in killing or wounding or attempting to kill or wound wild birds or wild quadrupeds.
The parts I call into question are, lying in wait for, iffy but if not attempting to kill something at that time is it illegal?, Also it says every attempt to kill or wound, is someone attempting to kill or wound by just sitting there waiting?
I didn't wanna waste a wardens time by calling them over it but didn't know if anyone here had the answer or any insight. Thanks, Zach
