Got word this morning that family successfully defended their rights against a Dormant Mineral Act claim. Not sure if the surface owner can or will appeal, but glad the ruling went in their favor.

were they the property owners or the mineral rights holders?

good deal...what was the case for refernece? I would like to read about the ruling...PM me if you want..

Must have "acted" within the 20 year look back period otherwise risk losing them to the surface holder.

I'll call or PM you guys once I have more details. The ruling was this morning, so I' not sure how long before you'll be able to find something on the web.

So they sued a landowner who must have believed he owned the mineral rights? I realize he should have been more careful with deed investigation before buying the place. But damn.

Fuck a ruling. If that happened to me good luck with a well. My first statement would have been "Not only will you not see a dime from this well, you better have your fire insurance paid up at home"
