Personally I've had only one negative reaction while "using it" not because of it, IMO. I was setup in a forked tree downhill of an oak flat littered with acorns on the ground. The flat laid anywhere from 15-50 yards to my NNW with a half dozen shooting windows or lanes in that direction. The wind was light and mostly steady and around 10 mph that morning.
On my way in under darkness I jumped what sounded like several deer from this oak flat which they do like to bed around, mostly along the lip of the slope facing my tree. I sneak into this set from a creek bed to the south just 30 yards away. The deer didn't run too far as I'm just 50 yards from a standing cornfield. I was very quiet climbing up into my stand but I knew these same deer might be back to investigate cuz in my past experiences, they always do, especially mature nanny does! Sure enough just like clock work, 20-30 minutes after first light she and her two half grown little ones were back and she was on high alert. She acted as though she was "looking" for me. The little ones couldn't have cared less and were somewhat playful and more in the mood to snack on acorns and browse but big momma, she was looking for me! Once she noticed my figure sillouetted in the skyline I was put through one of the roughest 30 minute stare downs I've ever been through! Head bobbing,snorting, stomping and repeat......over and over again! She stretched her nose as high into the air as she could licking her nostrils repeatedly with her eyes trained on me at the same time. A couple times she burst outta there doing that 3 snort burst most deer do when fleeing danger only to stop 10 yards away with ears straight back and looking away, then snap her head around hoping to catch me moving! It was quite the show of playing "flinch" by I was growing painfully tired of it and losing my patience near the end. Finally after all of her shenanigans that lasted nearly 45 minutes she just gave up and walked away. I could have shot her several times throughout this entire episode when her head was behind some massive trees but I don't shoot does on this property anyway.
I shared this long story just to make a point. Just because a hunter is using smoke or any other camo pattern or scent eliminating spray and gets busted doesn't mean "product failure"! We as hunters have to take most of the blame and not use these products like their fool proof.
